1. Agreement to Terms
By accessing or using FlowSync's website at flowsync.pro or the FlowSync application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
FlowSync is an irrigation scheduling and field service management platform. The Service includes:
- A web-based progressive web application (PWA) for scheduling, field documentation, and team coordination.
- A marketing website providing information about our products and services.
- Email communications related to your account and product updates.
3. Accounts and Registration
To use certain features of the Service, you may need to create an account. You agree to:
- Provide accurate and complete information.
- Keep your account credentials secure and not share them with others.
- Notify us immediately at hello@flowsync.pro if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
4. Subscription Plans and Payment
4.1 Free Tier
FlowSync offers a free tier with limited features. The free tier does not require a credit card and may be used indefinitely, subject to the usage limits described on our pricing page.
4.2 Paid Plans
- Paid subscriptions are billed monthly or annually as selected at the time of purchase.
- All fees are in US Dollars and are non-refundable except as required by law.
- We may change pricing with 30 days' notice. Price changes do not affect your current billing period.
4.3 Cancellation
You may cancel your subscription at any time. After cancellation, you retain access to paid features until the end of your current billing period. Your account then reverts to the free tier.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
- Interfere with or disrupt the Service or its infrastructure.
- Reverse engineer, decompile, or disassemble the Service.
- Use automated tools (bots, scrapers) to access the Service without our written permission.
- Upload content that is malicious, harmful, or infringes on others' rights.
- Resell or redistribute the Service without our written consent.
We reserve the right to suspend or terminate accounts that violate these terms.
6. Your Data and Content
6.1 Ownership
You own all data and content you create or upload to FlowSync, including schedules, photos, voice notes, and field records.
6.2 License to Us
By uploading content to FlowSync, you grant us a limited license to store, process, and display your content solely to provide the Service to you. We do not claim ownership of your content and will not use it for any other purpose.
6.3 Data Export
You may request a copy of your data at any time by contacting hello@flowsync.pro.
7. Intellectual Property
The FlowSync name, logo, website, and application code are owned by FlowSync and protected by copyright and trademark laws. You may not copy, modify, or distribute our intellectual property without written permission.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not guarantee that the Service will be uninterrupted, error-free, or secure.
- FlowSync is a scheduling and documentation tool. We are not responsible for irrigation system performance, water pressure, equipment failures, or crop/landscape damage.
- GPS data, weather information, and scheduling suggestions are provided for convenience and may not be fully accurate. You are responsible for verifying information in the field.
- FlowSync is not a substitute for professional engineering, hydraulic analysis, or licensed contractor services.
9. Limitation of Liability
To the maximum extent permitted by law, FlowSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify and hold FlowSync harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice. Upon termination:
- Your right to use the Service ceases immediately.
- We will retain your data for 30 days to allow you to request an export, after which it will be deleted.
- Provisions that by their nature should survive termination (liability, indemnification, dispute resolution) will survive.
12. Dispute Resolution
Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation. If we cannot resolve a dispute informally, it will be subject to binding arbitration under the rules of the American Arbitration Association, conducted in the United States. You agree to waive your right to a jury trial.
Nothing in this section prevents either party from seeking injunctive relief in court for urgent matters.
13. Governing Law
These Terms are governed by the laws of the United States. Any legal proceedings will be conducted in English.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
